In a surprising turn of events, Harvey Weinstein’s 2020 convictions have been overturned nearly four years after the jury deliberated in New York. The 72-year-old is facing 16 years of prison time in California, so in practicality, this will likely mean little in terms of actual time served.
However, when considering the emotions of the alleged victims of Weinstein, this is devastating. Lady Justice can be a cruel mistress who is not as sensitive as many of us likely hope. We rely on her to guide her justice system, in good times and bad. That being said, this is a truly tragic event for so many individuals. Legal technicalities mean little to victims. Our hearts are with them at this trying time.
Harvey Weinstein’s Overturned Conviction
The overturning of Weinstein’s conviction on April 25th exclusively surrounds decisions made by the judge preceding the case. That’s not a criticism of Judge Burke’s decision as much as it is an observation that is not a reflection on any other aspects of the trial.
Harvey Weinstein’s lawyer, Arthur Aidala, felt that his client’s overall character was being judged, and not just for the specific charges on trial. Those charges, by the way, were criminal sexual acts in the first degree and rape in the third degree. What can be brought to trial as “prior act” evidence is often controversial at best and can result in the overturning of cases in many instances.
In this case, the prior acts allowed were the testimony of three other women who have come forward as victims of Weinstein. Their allegations have not resulted in charges (yet), meaning they fall under prior act evidence. Aidala also suggests that Judge Burke allowed prosecutors to question Weinstein on his general behavior and not just on the specific charges.
The difference between providing context on an individual’s behavior as it pertains to the charges at hand and creating unfair bias and prejudice for the defendant is cloudy. Unfortunately, Judge Burke weighed enough on the latter side that Harvey Weinstein’s appeal went through.
Weinstein Hospitalized After Overturning
Harvey Weinstein is celebrating his convictions being overturned by going to the hospital on Saturday, April 27th. According to his publicist, Juda Engelmayer, transfers from Rikers to court triggered Weinstein’s health problems. He has many health issues that warrant close monitoring, which is very difficult to do during a transfer.
Aidala reported that “they examined him and sent him to Bellevue. It seems like he needs a lot of help, physically. He’s got a lot of problems. He’s getting all kinds of tests. He’s somewhat of a train wreck health-wise.”
Once Weinstein is stabilized, he will be sent back to Rikers. He will then be transferred again to appear in front of the Manhattan Supreme Court on May 1st. The Supreme Court generally does not prefer rescheduling appearances.
Theoretically, Harvey Weinstein will be facing a much longer multi-state transfer to California when he completes his 16 years of prison there. He was found guilty in 2022 of multiple charges surrounding an assault in 2013. No overturning of convictions is in sight for that particular charge in Los Angeles.
87 different individuals have accused Weinstein of problematic behaviors or assaults. Depending on whether those cases ever get tried or not, it could result in a lot of transfers for trial for Weinstein. Having a condition so sensitive to transfers could prove difficult for Harvey Weinstein in the future in any legal situation he finds himself in.
