Former Baltimore City’s State Attorney Marilyn Mosby Sentenced on 3 Condemning Charges

The once-renowned Baltimore state attorney, Marilyn Mosby, was the youngest chief prosecutor of any major U.S. city in 2015. The one who charged 6 police officers in the case of Freddie Gray, a Black man fatally injured in police custody, was prosecuted herself in two federal court trials. One for two counts of perjury and the other for one count of mortgage fraud. If the maximum sentence is applied, she might be facing 40 years in prison but if not, it will be less impactful. The Perjury Counts Marilyn Mosby is Charged With

Based on the evidence presented at trial, on May 26, 2020, and December 29, 2020, Mosby submitted “457(b) Coronavirus-Related Distribution Requests” for one-time withdrawals of $40,000 and $50,000, respectively, from the City of Baltimore’s Deferred Compensation Plan.

Trial evidence proved that Marilyn Mosby falsely certified that she was financially harmed by the Coronavirus. In signing the forms, Mosby “affirm[ed] under penalties for perjury the statements and acknowledgments made in this request.”

What was shown at trial was that Mosby did not experience any such financial hurdles and as a matter of fact, she received her full gross salary of $247,955.58 from January 1, 2020, through December 29, 2020, in bi-weekly gross pay direct deposits of $9,183.54. Additionally, it turns out that she put these $90,000 in down payments on vacation homes in Kissimmee and Longboat Key, Florida, would someone suffering financially do so?

The Mortgage Fraud Count Marilyn Mosby is Charged With

Now concerning the mortgage fraud, the allegation stems from a $5,000 “gift letter” from her husband Marilyn Mosby submitted when taking a loan to buy the Longboat Key property. Turns out it was her own money all along, where she transferred the $5,000 to her husband who then transferred them back to her again.

In addition to the possibility of facing prison time of up to 30 years for this crime, Judge Griggsby ruled that Marilyn Mosby must surrender the assets gained through “her crimes.” Meaning that she would have to forfeit her Florida condo and 90% of the proceeds since Mosby put 10% down to secure the mortgage, which amounted to more than $40,000. The mortgage of $428,000 was fraudulently obtained and she is to pay them.

The Sentencing

If the maximum sentence were to be applied, Marilyn Mosby would have gotten 10 years in prison for two counts of perjury and 30 years for the count of mortgage fraud, which adds up to 40 years in federal prison. However, this was far from being the case, she was sentenced to three years of supervised release and 12 months of home confinement while having to do 100 hours of community service on all charges.

Marilyn Mosby and her public defenders said that they would appeal both verdicts. She has pushed nationally for a presidential pardon and maintained her innocence and she claimed that she was targeted by prosecutors for her progressive stances despite what she was being convicted of. On the bright side, though, she will be back in her home with her two daughters and not away in a jail cell.
