The criminal case against the man accused of fatally shooting conservative activist Charlie Kirk entered a critical phase Monday as prosecutors began presenting evidence they say links him to the 2025 assassination. The multiday preliminary hearing will determine whether there is enough evidence for the case to proceed toward trial, where prosecutors intend to seek the death penalty.

Tyler Robinson, 23, appeared in Utah court for the hearing but has not yet entered a plea. Because Robinson was charged through an information rather than a grand jury indictment, Utah law requires prosecutors to publicly establish probable cause before the case can move forward, according to CNN. At this stage, prosecutors are not required to prove guilt beyond a reasonable doubt.

Kirk, the 31-year-old co-founder of Turning Point USA, was speaking before an estimated crowd of 3,000 people at Utah Valley University in Orem on Sept. 10, 2025, when he was shot. The conservative activist, author and father of two died from his injuries. His death drew national attention and renewed concerns about political violence in the United States.

According to court filings reported by CNN, prosecutors plan to present surveillance footage, photographs of the alleged murder weapon, ballistics evidence and testimony from multiple law enforcement officers during the hearing.

The state is also expected to play a recorded interview from Robinson’s former roommate, who prosecutors have described as Robinson’s romantic partner. According to prosecutors, the roommate received limited immunity in exchange for cooperating with investigators and providing a statement in April.

Fox News reported prosecutors also intend to introduce digital evidence, including alleged text message confessions and communications sent through the Discord messaging platform.

According to prosecutors, investigators recovered a Mauser Model 98 .30-06 caliber rifle wrapped in a towel in a wooded area near the suspect’s alleged escape route. Prosecutors allege Robinson’s DNA was found on the rifle’s trigger, the towel, multiple cartridges and a screwdriver recovered near the rooftop, which investigators believe was used during the shooting.

CNN also reported that investigators intend to introduce surveillance video allegedly showing a person dressed in dark clothing on a nearby rooftop minutes before the fatal shot. Prosecutors say the individual was later seen fleeing across the roof while carrying an object shaped like a rifle before disappearing into a wooded area.

Prosecutors Allege Handwritten Note And Messages Linked Robinson to Shooting

According to charging documents cited by CNN, prosecutors allege Robinson left a handwritten note beneath a keyboard before the shooting that read, “I had the opportunity to take out Charlie Kirk and I’m going to take it.”

Investigators also allege Robinson exchanged text messages with his former roommate after the shooting in which he admitted responsibility. According to prosecutors, Robinson later instructed the roommate to delete the messages, destroy the handwritten note and remain silent if questioned by police.

Fox News reported prosecutors also allege Robinson discussed returning to recover the rifle after the shooting before eventually surrendering to authorities the following day with assistance from his parents and a family friend.

Defense Challenges Forensic Evidence And Media Coverage

Robinson’s attorneys have disputed several portions of the state’s evidence and are expected to call three forensic experts during the hearing, according to CNN.

Among the defense’s arguments is that forensic testing found DNA from multiple individuals on some evidence collected by investigators. Defense attorneys have also pointed to a federal firearms analysis that could neither identify nor exclude the recovered rifle as the weapon that fired the bullet fragments recovered from Kirk’s body.

According to CNN, defense attorneys previously sought to delay the preliminary hearing, arguing they needed additional time to review extensive discovery materials and forensic evidence. They also objected to allowing television cameras inside the courtroom, arguing that extensive media coverage could jeopardize Robinson’s right to a fair trial.

The judge ultimately allowed cameras in much of the hearing. Prosecutors argued public access would help counter misinformation and conspiracy theories surrounding the high-profile case, according to CNN.

Family Attends Emotional Hearing

Charlie Kirk’s widow, Erika Kirk, and his parents attended Monday’s hearing. In a statement reported by both CNN and Fox News, the family described the proceedings as another painful reminder of their loss.

“Charlie was a beloved husband, son, brother, friend and father,” the statement said. “Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children.”

The family thanked supporters for their continued prayers and asked for privacy while the judicial process continues.

The hearing is expected to last several days. If the judge determines prosecutors have established probable cause, Robinson will be formally arraigned and enter pleas before the case proceeds toward trial. Prosecutors have indicated they will seek the death penalty if Robinson is ultimately convicted of aggravated murder.

Monday’s hearing marked the first extensive public presentation of the prosecution’s evidence since Kirk was killed nearly 10 months ago, giving both families and the public their clearest look yet at the case expected to shape one of Utah’s highest-profile criminal trials in recent years.
